Hi Paul,

First off, I am sorry to hear about these issues you seem to be having - it cannot be easy for you and your family.

Secondly, I want to make sure that you recognize that I am not a lawyer, so you should not construe what I am saying as legal advice. This is not legal advice and is simply advice that I would give to one of my personal friends if they were to tell me what you have just told me. Again, this is not legal advice.

It seems to me that if the lawyer who you took with you to the Social Security office thinks that you should contact a civil rights lawyer then you probably should. Lawyers, even if they are not experts in a certain area of practice, are still trained in the law (they did go to law school after all) and as a result they do know things about general legal principles that apply across many different legal matters. If he seemed to think that you should contact a civil rights lawyer then I would assume that he thinks you might have a pretty good chance of actually having a case given your circumstances.

I would try and find a reputable, wise, and experienced lawyer - and the only way that you are going to be able to do that is to do some research, make some phone calls, and get educated about your situation. This seems like something you are already doing.

Thanks for stopping by.

basically a san diego county government worker Falsely claimed on a federal government paper she sent to me for benefits that they "reviewed my case" that since i started a new job, that we our family were not entitled to any increase in benefits. Basically lying since she 'could not reviewed anything or did her job since I was not working for anybody.

when I sent her a letter and complained to her supervisor the day we got the letter, 2 weeks later we got a notice that our benefts are being cut off, supposedly for now unreported unemployment benefits, which I showed her that I was not since I was disqualified for 2 years for not reporting that I was working to them for three weeks, which was due to not getting a paycheck, but also then it was due to the crossover period when i signed up for ui and then got a job, but was not long enough to get any benefits anyhow, and I lost a 2 appeals, which then she comes up with that I got a full year of benefits 6550.00, yet then edd had sent me another appeal denial letter for NO benefits, basically contridicting themselves.

Then when I went to the appeal hearing yesterday with social security lawyer, the county welfare person said they could not hear me since I did not advise them I was bringing a lawyer, since they say they required it, but as I see which I do not really have to, and then they denied me a hearing which I came prepared and they did not. I was told by the lawyer I SHOULD SEEK A CIVIL RIGHTS LAWYER since the county denied me the hearing, and now they want to schedule another informal hearing to bring their lawyer. They said they were going to send me a reason why since they can do as they please she said. The county worker under Federal law title 18 section 1001 clearly LIED and did not do her job, and our complaint to the supervisor of hers resulted in harmful conduct to us by cancelling our benefits.

any case or who can I go to since the county employee lied, and I feel it is retailiation

It really is a hard process to find a good lawyer that fits your needs. You outline a few specific criteria to look for and it really helps with the process. Thanks for the advice!
